REASONS FOR DECISION
[1] This is a meritless appeal brought solely, it would seem, to delay judgment. As the motion judge noted: “To date, there have been no payments made on the debt. [Ms. Wang] admits that the arrears have not been paid. She admits the debt.” The appellant’s submission that her efforts to repay the debt were obstructed were rejected by the motion judge. The motion judge explained that “[t]he only issue appears to be whether the [appellant] ought to have been provided the opportunity to pay the arrears over a six month period.” In her view, “[t]hat proposal was unequivocally not accepted by the [respondent].”
[2] There has been no payment since, and the debt remains unpaid.
[3] There is no evidence that the debtor was in a position to honour the respondent’s reinstatement proposal. There is no genuine issue for trial and summary judgment was properly granted.
[4] The appeal is dismissed with costs payable to the respondent in the amount of $5,000, all-inclusive.
